This 'WA Law' specifically covers:
*Who is responsible for the safe moving of ALL freight in WA;
*Load dimensions; and
The requirements of the transport provider & drivers has remained relatively unchanged, however, if as a customer, you or your personnel are involved in any of the following 'Road Transport Activities', then you are party in the CoR & may be deemed liable in the event of a breach of the road laws:
*Consigning - a person or company commissioning the transport of goods;
*Packing - placing goods in packages, containers or on pallets;
*Loading - placing or restraining the load of the vehicle;
*Driving - the physical act of driving a vehicle;
*Operating / Managing - a business which controls the use of a vehicle;
*Receiving - paying for goods / taking possession of the load; and
*Scheduler - whilst not defined as a role in WA legislation, there are provisions to include these duties.
Mass & Dimensions. It is now of the utmost importance that weights & dimensions are true & correct. False or incorrect declarations (including e-mails) resulting in a breach can result in a fine to all parties & / or in the event of an accident, possible criminal charges & civil litigation.
Load Restraint. Load restraint is based on the NTC Load Restraint Guide (second edition 2004) & in basic terms, explains & highlights the requirements of preparing & restraining goods for transport. The use of appropriate pallets & securing equipment is now the responsibility of the consignor. Additionally, loaders should complete a 'Load Restraint Course' & be certified accordingly. FYI, all drivers in the Tri State Transport fleet have completed this training.
